U.S. Magistrate Judge Williams Duffin ordered the release of Brendan Dassey on Monday. Dassey had been convicted of helping his uncle, Steven Avery, kill Teresa Halbach in 2005.
Judge Duffin had ruled in August that Dassey was tricked into confessing by investigators, but the state has since appealed that ruling.
After the release was ordered, Wisconsin Attorney General Brad Schimel stated that he would put in an emergency motion in 7th U.S. Circuit Court of Appeals to put the release order on hold.
Dassey’s release will not be immediate, and does come with multiple conditions, but his attorney says that he hopes Dassey will be released in time to spend Thanksgiving with his family.
In the conditions Dassey may not violate any laws, he must appear in court as required and serve any sentence ordered by the court, he must also be supervised by the United States Probation Office and be available for any home visit the office deems necessary.
Both Dassey and Avery are currently serving life sentences for their role in the murder of Halbach, which they’ve served since 2007. They received national attention because of the release of the popular Netflix series “Making a Murderer.”
