WAUPACA, WI- 20-year-old Evan Barnick appeared in Waupaca County court, where a $150,000 cash bond was established. Barnick faced a range of charges, including homicide by intoxicated use of a motor vehicle, hit and run resulting in death, OWI-third offense (Operating While Intoxicated), operating while revoked, and lacking an ignition interlock device. During this court appearance, Barnick waived his right to a preliminary hearing and entered not guilty pleas. A trial date remains undetermined, with Barnick scheduled to return to court on December 19.
According to the police report, a man who had stopped to assist a disabled motorist on the roadside met was killed after being struck by a vehicle.
In response to police inquiries, Barnick acknowledged consuming alcohol but denied striking the victim. However, the evidence showed that his vehicle exhibited damage consistent with a collision involving a person. Further investigation revealed that Barnick had two prior convictions for OWI and was obligated to operate only vehicles equipped with an ignition interlock device due to his revoked license status and .02 restricted license.
