SHAWANO COUNTY, WI – As the popularity of ATV and UTV use continues to grow across Shawano County, local law enforcement is reminding riders that open intoxicants are not allowed on public roadways, even in recreational vehicles.
According to Shawano County Sheriff’s Deputy George Lenzner, having an open alcoholic beverage while operating or riding in an ATV or UTV on the road is a violation of Wisconsin law.
“It’s considered an open intoxicant violation,” Lenzner explained. “So if you’re on the roadways, you cannot have an open alcoholic beverage in that ATV or UTV.”
While the rules may seem similar to those for passenger vehicles, the consequences for violations differ slightly. Lenzner said that if someone is caught drinking while operating an ATV or UTV, they could be cited and fined, but they would not lose their driver’s license.
“When somebody gets an OWI on a UTV, they don’t lose their license. It’s just a forfeiture they pay,” he said.
The sheriff’s office continues to encourage riders to understand the rules that apply to ATV and UTV operation — particularly when it comes to alcohol — to ensure safety on the trails and roadways.
