A Waukesha County Circuit Court judge has decided a father who caused his son’s death last summer shouldn’t go to jail. Twenty-six-year-old Nicholas Dischler fell asleep at the wheel, causing the wreck which killed three-year-old Nathaniel. The judge sentenced Dischler to five years probation, saying his guilty plea, clean record and obvious remorse were factors. The family had been celebrating the boy’s birthday when Dischler decided to drive him home despite getting very little sleep. He admitted drinking before getting behind the wheel but he wasn’t legally drunk.
